Subject: Measures to Prevent Corruption and Malfeasance

            In order to ensure effective administration by the NCPO, particularly in providing security for the people, maintaining peace and order, and safeguarding national interests, the NCPO hereby orders the following measures to be taken in relation to preventing and tackling the problem of corruption and malfeasance in public office:

            1. All public sector and government agencies are to lay down measures or approaches to prevent and solve the problem of corruption and malfeasance in public administration and government agencies, with an emphasis on promoting good governance and promoting the participation of all sides in scrutiny and monitoring to check corruption and malfeasance.

            2. Where an accusation is made, or there is a cause to suspect, that a civil servant and a government officer commit or are involved in corruption and unlawful practices, whether as offender, solicitor or accomplice, the head of the relevant government office and agency shall take measures in accordance with the powers and responsibilities under the Organization of State Administration Act B.E. 2534 (1991) and the Royal Decree on Criteria and Procedures for Good Governance B.E. 2546 (2003), in addition to other relevant laws, regulations and orders concerning human resource administration. Disciplinary, administrative and legal measures are to be enforced strictly and promptly.

            3. Regarding government procurement, the heads of government offices and agencies shall have the responsibility to strictly control and oversee the process to ensure compliance with the Organic Act on Counter Corruption B.E. 2542 (1999).

            4. Where the head of a government office or supervisor is negligent and fails to implement clauses 2 and 3 above, it is to be considered a disciplinary or criminal offense, as the case may be.

             5. The Office of the National Anti-Corruption Commission shall seek, collect and undertake other actions to obtain facts and evidence in order to learn the details of and prove corruption allegations within the public sector. In addition, they shall monitor and expedite the implementation of clauses 1-4 above, and report the results and present their views for the NCPO’s information and consideration continually.

            This announcement shall take effect immediately.
