Thailand reaffirms that the Ta Muen Thom Temple and the Ta Kwai Temple are archaeological and sacred sites situated entirely within the territory of Thailand, in areas delimited by the Franco-Siamese Treaty of 1907 and the Protocol annexed thereto, as further clarified by relevant documents relating to the implementation of that Treaty.
Thailand maintains responsibility for the restoration and preservation of archaeological sites within Thai territory. Ta Muen Thom Temple was formally registered as a Thai archaeological site in 1935, and restoration works have been continuously carried out since that time. With regard to Ta Kwai Temple, Thailand conducted surveys at the site during 2001 and 2002 without any objection from the Cambodian side. Since then, Thailand has consistently preserved and promoted these sites as cultural heritage and tourist attractions.
All actions undertaken by the Thai side during the armed clashes with Cambodia have been fully in accordance with international law, including the 1954 Hague Convention for the Protection of Cultural Property in the Event of Armed Conflict. By contrast, the Cambodian side deliberately exploited historic and cultural sites for military purposes, in conscious disregard of its obligations under international law.
Thailand reaffirms its commitment to the peaceful resolution of issues through existing bilateral mechanisms and to the protection of our cultural heritage. Thailand remains open to constructive dialogue aimed at reducing misunderstandings and resolving differences amicably, with mutual respect and in good faith.
